TERMS OF SERVICE

These Terms of Service govern your use of the Elliot Farm website and your purchase or use of products, memberships, subscriptions, content, and related services offered by Elliot Farm LLC, doing business as Elliot Farm.
Throughout these Terms, “Elliot Farm,” “we,” “us,” and “our” refer to Elliot Farm LLC. “You” and “your” refer to the customer, website visitor, member, or other person using our services.
By visiting our website, creating an account, purchasing a product, or beginning a membership, you agree to these Terms of Service and to our Privacy Policy, Return and Refund Policy, and Shipping and Pickup Policy.
1. ELIGIBILITY
You must be legally capable of entering into a binding agreement to make a purchase or begin a membership.
You agree to provide current, complete, and accurate information when placing an order or creating an account. You are responsible for protecting your account credentials and for activity conducted through your account.
2. PRODUCTS AND AVAILABILITY
Elliot Farm offers perishable food products, farm products, baked goods, memberships, subscriptions, add-ons, and other items as made available from time to time.
Our products are handmade, farm-produced, seasonal, or sourced in limited quantities. Product availability, ingredients, menus, appearance, size, weight, color, texture, and flavor may vary.
Photographs and illustrations are provided to represent our products and brand but may not depict the exact item a customer receives.
We may limit quantities, discontinue products, change weekly menus, or make reasonable substitutions when ingredients or products become unavailable. When practical, we will communicate material changes that affect a customer’s order.
We reserve the right to refuse, limit, or cancel an order when we reasonably believe the order resulted from an error, product shortage, fraudulent activity, misuse of the website, or another legitimate business concern. If we cancel a paid order, we will refund the applicable amount.
3. PRICES AND PAYMENT
Prices are shown in United States dollars unless otherwise stated. Applicable taxes and charges are displayed at checkout when required.
Prices, products, and offers may change without notice. A price change will not alter an order that has already become final unless the original price resulted from an obvious error.
You agree to provide a valid payment method and authorize Elliot Farm and its payment providers to charge the amount shown at checkout.
4. WEEKLY MEMBERSHIPS AND RECURRING BILLING
The Elliot Farm Box is offered as a recurring weekly membership.
By beginning a membership, you authorize Elliot Farm and its payment providers to charge your selected payment method on a recurring weekly basis until the membership is skipped, paused, or canceled in accordance with these Terms.
Members are generally billed each Wednesday for that Saturday’s box.
Members may make changes, add eligible extras, skip a week, pause, or cancel through their customer account. Changes must be completed by Wednesday at 8:00 PM to apply to that Saturday’s order.
Changes made after the weekly cutoff ordinarily apply to the following eligible order rather than the order already being prepared.
You are responsible for managing your membership and keeping your payment information current. Failure to review an email, reminder, menu, or renewal notice does not automatically entitle you to a refund.
We may change membership pricing, contents, pickup procedures, or other recurring terms. When a material change affects an active membership, we will provide notice as required by applicable law and give members a reasonable opportunity to cancel before the change takes effect.
5. LOCAL PICKUP
Elliot Farm currently offers local pickup rather than delivery or shipping.
Pickup is generally held each Saturday from 9:00 to 11:00 AM in Clinton, South Carolina. Exact pickup instructions are provided to members or customers after ordering.
Customers are responsible for retrieving their orders during the communicated pickup period. Another person may retrieve an order using the name associated with the account.
Orders not retrieved during the pickup period are subject to our Shipping and Pickup Policy and Return and Refund Policy. Alternate pickup arrangements are not guaranteed.
6. FOOD SAFETY, STORAGE, AND ALLERGENS
Our products are perishable and must be transported, stored, and consumed appropriately.
Customers are responsible for promptly refrigerating eggs and any other items identified as requiring refrigeration. Bread and baked goods should be stored and consumed according to the instructions provided with the product.
Our kitchen handles wheat, eggs, milk, tree nuts, peanuts, and other common allergens. Cross-contact may occur. We do not represent or guarantee that our kitchen or products are free from any particular allergen.
Customers with allergies, sensitivities, medical conditions, or special dietary requirements are responsible for reviewing ingredient information and deciding whether a product is appropriate for them.
7. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, replacements, credits, missed pickups, subscription cancellations, and product concerns are governed by our Return and Refund Policy.
Because our products are perishable and prepared specifically for customers, many sales become final after the applicable weekly cutoff.
8. WEBSITE USE
You may use our website only for lawful personal or business purposes related to evaluating or purchasing our products and services.
You may not:
• Use the website for unlawful, fraudulent, or abusive activity
• Attempt to interfere with the website’s operation or security
• Introduce malicious code
• Access another person’s account without authorization
• Scrape, reproduce, or commercially exploit website content without permission
• Misrepresent your identity or payment information
• Use our trademarks, photographs, illustrations, writing, or other content without authorization
We may suspend or terminate access to the website or an account when we reasonably believe these Terms have been violated.
9. INTELLECTUAL PROPERTY
The Elliot Farm name, logo, website design, illustrations, photographs, written materials, product descriptions, recipes when identified as proprietary, and other original content are owned by Elliot Farm or used with permission.
No ownership rights are transferred to you through your use of the website or purchase of our products.
10. THIRD-PARTY SERVICES
Our website and services may rely on third parties, including Shopify, payment processors, subscription platforms, email providers, and other service providers.
Your use of certain third-party features may also be governed by the provider’s own terms and privacy practices. We are not responsible for a third party’s independent acts, omissions, outages, or policies, except to the extent required by law.
11. WEBSITE AVAILABILITY AND INFORMATION
We attempt to keep the website and its information accurate and available, but we do not guarantee that the website will always operate without interruption, delay, error, or technical difficulty.
We may correct errors, update information, or modify the website at any time.
12. DISCLAIMER OF WARRANTIES
Except for any warranty or right that cannot legally be excluded, our website, content, and services are provided on an “as available” basis.
We do not make warranties beyond the express commitments stated in these Terms, our policies, or applicable law.
Nothing in these Terms limits our responsibility to provide food that meets applicable legal and safety requirements.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Elliot Farm will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of the website or services.
Our total liability relating to a particular order will not exceed the amount paid for that order, except where a different limitation is required by law.
These limitations do not apply to liability that cannot legally be excluded or limited.
14. INDEMNIFICATION
To the extent permitted by law, you agree to reimburse Elliot Farm for reasonable losses, liabilities, or expenses resulting directly from your unlawful use of the website, fraudulent conduct, violation of these Terms, or infringement of another person’s rights.
15. SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.
16. NO WAIVER
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
17. GOVERNING LAW
These Terms and any transaction with Elliot Farm are governed by the laws applicable in the State of South Carolina, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
18. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our services, operations, or legal obligations. The updated version will be posted on this website with a revised “Last updated” date.
Changes will not apply retroactively when prohibited by law.
